Supreme Court affirms Match lawsuit dismissal

The U.S. Supreme Court on Jan. 8 announced it has denied the petition of the plaintiffs in Jung et al v Association of American Medical Colleges et al, seeking a further review of the prior dismissals of the case. The suit, which had been pending since May 2002, alleged that the National Resident Matching Program (NRMP) and other organizational sponsors conspired to violate federal antitrust laws. Claims against the AMA and two other defendants had been dismissed in early 2004, and claims against the rest of the defendants (including the NRMP, the Accreditation Council for Graduate Medical Education, the American Association of Medical Colleges and numerous teaching hospitals) had been dismissed in late 2004 after Congress passed legislation making clear that mere participation in the residency matching program does not violate federal antitrust laws. The AMA-MSS and AMA-RFS had recommendations to officially oppose the NRMP antitrust litigation.
